TVXQ's fans had started their second round of signature petition.
DNBN had announced that they would start their second round of signature petition on the 25th of August. They expressed that they will be focusing on ‘being against the inhuman slavery contract’ by SME. The signature exercise will be from the 26th of August until the 4th of September 2009 (10 days), and they planned on submitting this on the 8th of September 2009.
Cassiopeia had submitted their first signature petition regarding the lawsuit of Jaejoong, Junsu and Yoochun against SM Entertainment to the Seoul District Court last 20th of August at 14:40. The petition consists of the signatures of 121,073 people from an offline petition from the 12th to the 18th of August (6 days).
On the other hand, during the first hearing on the 21st of August at the Seoul Central District Civil Court, SM Entertainment and the three members of TVXQ had different points of view. As always, SM Entertainment focused on ‘attacking’ the cosmetics business that the members had invested in, while Jaejoong, Junsu and Yoochun's center of attention was the unlawful contract.
The representative lawyer from SM said, “Because of the lawsuit issue, it is estimated that SM Entertainment would lose 18 billion won internally and 150 billion won overseas, and being labeled as an ‘immoral company.’” The lawyer also emphasized that the lawsuit issue should focus on the cosmetics investment, as problems regarding the members' contract should take under the consideration SM's current situation. As for the problem of revealing all related documents of TVXQ's earnings, they stated that the boys are paid every six months, and every one of them had also signed the receipts.
However, the three members had a different POV. They once again emphasized that “The main focus of this lawsuit is the unlawful contract,” and they are not giving up yet. They also mentioned that “Even if they are not under the same company, they will go for activities together. They do not wish to disband nor be separated.” It seems like they are decided to separate from SM Entertainment.
On the other hand. the two parties expressed that they do not wish for TVXQ to disband. The Seoul District Court encouraged them to resolve this in good terms, so that there is a chance that this would be resolved peacefully. In addition to this, the Court stated, “As entertainers with the world's biggest fanclub, they should take into consideration their own responsibilities and the close relationship between the members. Hopefully this issue will be resolved peacefully.”
